  • The Durable Power of Attorney Is a  By : Berber
It is important that each adult in the United States have four legal documents. One of these is a "durable power of attorney." The durable power of attorney is just a form agreement used as part of an individual's estate planning.

The durable power of attorney will provide management continuity and control of the individual's assets and business affairs when he or she becomes incompetent or can't manage things for him or herself. The individual making out the durable power of attorney is called the "principal," and the person who will take over for the principal is called the "agent." A "durable" power of attorney is distinguished from a "general" power of attorney, because it has a provision in it that says that the powers of the agent will endure beyond the incompetency of the principal. If you were to be judged incompetent, a general power of attorney would become ineffective. Over time it became obvious that a power of attorney is more important after a principal is determined incompetent and unable to function. Therefore, laws were written which made the power of attorney survive the principal's incompetency.

While the importance of a will and revocable living trust is well known, many overlook the critical necessity of a durable power of attorney. You are more likely to be rendered incompetent and unable to manage your financial matters than you are to die within the next few weeks. Dealing with a dead person's assets is usually easier than having that person declared incompetent and managing their assets while they are alive.

Unless there is a durable power of attorney in place, it will be necessary for the court to appoint an agent or "conservator" for someone who has been determined to be incompetent. An important part of the durable power of attorney is the mechanism that will be used to declare the principal incompetent.
A well written power of attorney will allow power to transfer smoothly to the agent without any court involvement. If two doctors sign a statement signifying that a person or principal is unable to manage his business affairs, this will usually satisfy the criteria contained in a durable power of attorney. A principal's incompetency is often certified by some combination of doctors, family members, or clergy.

An agent named in a durable power of attorney can be given broad powers to manage the affairs of the principal. In addition to a principal's financial matters, a durable power of attorney can give the agent authority to oversee the religious, social and medical concerns of the principal. One type of durable power of attorney only deals with medical issues; therefore it's called a "medical durable power of attorney." An individual has the option of combining the durable power of attorney, Health Insurance Portability and Accountability Act (HIPPA) agreement, medical power of attorney, and living into one master agreement, or keeping them separate.

Every adult in your family should have a durable power of attorney. Choose the form or arrangement that best fits your needs. You just sign the forms and put them in the filing cabinet. A durable power of attorney can come to the forefront and save you time, money and aggravation at the time of a family or individual hardship.

  • Is Moving Tax Deductible?  By : Sagar Aquila0 Sagar Aquila0
Is Moving Tax Deductible? The costs of moving are tax deductible under certain circumstances. Your employer reimburses some of the costs of moving if you are doing so at the behest of your company. What is given here is only general information and for any specific circumstance it is better to consult a tax professional.
Companies have more than one way of doing it. They might pay the moving company directly instead of handing over the cash to you personally. This also exempts you from paying any taxes to the government as such expenses do not come under the purview of your total wages on the Form W-2. It is not taxable, if you have to return any excess over and above your moving costs. But it is necessary to fill in the Form 3903 for Moving Expenses for them to deduct such costs. However it is better if all moving expenses are covered by your employer, including storage, temporary living as well as house-hunting expenses, not usually deductible. And if your boss happens to be generous enough to give you a gross advance payment or even a month’s pay as extra, you can safely cover the taxes if any, for the additional income.
